Artem Chigvintsev Was Not Returning for New Season of “Dancing with the Stars ”Before Arrest

The decision for Chigvintsev to not return to the ABC dance competition series was made before he received a felony charge of corporal injury to spouse on Aug. 29 in Napa Valley

Artem Chigvintsev will not be returning to the ballroom.

PEOPLE has learned there were no plans for the pro to take part in season 33 of Dancing with the Stars prior to his arrest on Thursday, Aug. 29.

Chigvintsev was arrested on charges of felony corporal injury to spouse in Napa Valley, Calif. He was booked with a $25,000 bail and released later that day.

The decision for Chigvintsev to sit out the upcoming season is not uncommon as professional dancers often rotate seasons based on celebrity castings.

The full cast for the new season of the ABC dance competition will be revealed Sept. 4 on Good Morning America. Olympic bronze medalist Stephen Nedoroscik was the first celebrity contestant to be announced.

Chigvintsev has competed in the last 12 seasons of the show — including the last four. He was most recently paired with former Bachelorette Charity Lawson, placing fourth in the competition.

He and season 29 partner Kaitlyn Bristowe, who was also a lead of The Bachelorette, won the mirrorball trophy in 2020.

Chigvintsev met his wife Nikki Garcia (formerly Nikki Bella) in 2017 when they were paired together on season 25 of Dancing with the Stars. At the time, Garcia was still in a relationship with then-fiancé John Cena but the pair split a year later.

The retired WWE wrestler later reconnected with Chigvintsev that same year, and the two eventually confirmed their romance in March 2019. They announced their engagement eight months later and in July 2020, they welcomed their first child together, son Matteo.

The Dancing with the Stars pro was arrested just before 10 a.m. on Thursday, Aug. 29. He was then booked in the Napa County Jail less than an hour later and released later that day.

The booking code indicates Chigvintsev's charge was for corporal injury to spouse and he was given a $25,000 bail, according to intake records obtained by PEOPLE. It has not yet been confirmed but given the charge, Chigvinstev's wife Garcia is presumably the spouse in question.

Season 33 of Dancing with the Stars will premiere Tuesday, Sept. 17 at 8 p.m. ET on ABC and Disney+, with the episode available to stream the next day on Hulu.
