Mother didn't call 911 for dying 4-year-old daughter because cell phone was 'low on minutes,' police say

A Texas mother charged in her 4-year-old daughter's death allegedly told police that she didn't call 911 because her cell phone was "low on minutes."

Jessica Briones is accused of causing her daughter Olivia serious bodily injury after she walked into the San Antonio police substation on Sept. 5 carrying the unresponsive child.

According to My San Antonio, the toddler had injuries on her head, face and arms.

When questioned about why she took the injured child to the police substation instead of calling 911, Briones allegedly told investigators that she couldn't find her cell phone and she was "low on minutes."

Olivia was immediately taken to University Hospital, where she was pronounced dead the following day.

An affidavit reportedly states doctors at the hospital found that Olivia's injuries were severe and consistent with a blow to the head. According to the report, the child had brain swelling and multiple bleeding sites inside her head.

The medical examiner's office also determined that the little girl had eight scars on her scalp, a black eye, a swollen nose, a deflated lung, a swollen wrist, a fractured vertebrae, a large abrasion on the back of her head, a bruised ankle and the tissue in her upper lip was detached from her gums. Both of the child's arms were also swollen.

The cause of death is still pending, the medical examiner's office told My San Antonio.

The 34-year-old mother allegedly told police that she didn't know how her daughter got such serious injuries but told investigators that a few days before Olivia died, she would often fall and hit her head.

Briones also allegedly said that she slammed the girl's arm in a door, but said it was an accident.

Briones was charged with injury to a child and could spend up to 99 years in prison if convicted.

The district attorney's office said the charges against her could be upgraded depending on Olivia's cause of death.
