Former Hopkinton sergeant Timothy Brennan appears before state POST Commission

BOSTON Suspended Milford Police Officer Tim Brennan had a hearing Friday before an officer of the Peace Officers Standards & Training (POST) Commission, which is holding its own investigation about what Brennan knew about an alleged sexual assault committed by a former superior.

Brennan was fired in February from the Hopkinton Police Department, where he was a sergeant. He was hired in July as a patrolman by the Milford Police Department, but is currently on unpaid leave per the POST Commission.

Friday's hearing was not conducted in public. Although most POST hearings are open, the presiding officer determined that "the closure is necessary to protect privacy interests and will not be contrary to the public interest," a spokeswoman for the POST Commission said.

Milford Police Chief Robert Tusino said Friday afternoon that he testified during the hearing but could not comment on what he said. Tusino, who previously said he would testify on Brennan's behalf, did say that the hearing officer took the matter under advisement.

Brennan's lawyer, Daniel Fogarty of Boston-based Sandulli Grace, could not be reached for comment on Friday.

Brennan has said assault victim would not corroborate report

Brennan has previously said in public statements that the accuser of former Hopkinton Deputy Police Chief John "Jay" Porter first told him about the allegations in 2017, when she was an adult.

Brennan said he didn't report those allegations because the victim had told him she wouldn't corroborate the story. He and his attorneys argued that by not reporting the assaults, Brennan made it possible for the accuser to come forward to the Middlesex District Attorney's Office.

Porter is awaiting trial after pleading not guilty to three counts of rape of a child.

It is unknown as to when the POST Commission will conclude its investigation.
